
Whew.. this whole Jussie Smollett situation seems to be the unwanted gift that keeps on giving…
Earlier this year Jussie Smollett claimed he was viciously assaulted by racist and homophobic attackers near his Chicago apartment. The attack was originally treated as a hate crime by the city and the actor received an out-pouring of support from his fellow “Empire” co-stars, fans, and even the White House, until it was discovered that Smollett may have fabricated the entire story and was actually the mastermind behind the whole thing.
The strange twist of events led to Smollett’s dismissal from the Lee Daniels' "Empire" and a major lawsuit against the actor from the city of Chicago to cover the cost of the investigation.
Now it’s been five months since the city sued the former “Empire” star and Smollett, who’s been seemingly under the radar (until now), refuses to go down without a fight.
Deadline reports Smollett’s attorneys recently filed a motion to dismiss the lawsuit against him, stating that “The City’s Complaint appears to be an unprecedented effort to seek penalties and resources expended in connection with allegedly false statements made to the police where the related criminal case concerning the statements was dismissed …on all counts”. The motion also notes that the entire Smollett prosecution has been “entirely improper." You can read the full motion here.
While the special prosecutor’s appointment has not yet been announced, they would have the authority to bring new charges against Smollett-- an appointment Smollett and his attorneys are also hoping to fight in their motion.
A hearing on Smollett’s motion to dismiss the city’s lawsuit has been set for August 13th and we’ll be waiting to hear the verdict…
