Rochester Mayor Suspends Officers Who Pepper Sprayed & Handcuffed 9-Year-Old + Girl’s Mom Plans To Sue

The police officers who handcuffed and pepper sprayed a 9-year-old girl have been suspended amid outrage at the police misconduct in the viral body cam videos circulating online. Several Rochester police officers have been suspended for misconduct after police cam videos of the officers handcuffing and pepper spraying a 9-year-old girl went viral, which sparked outrage online.

According to Rochester Mayor Lovely Warren, the suspensions will last until the conclusion of an internal investigation.

“I can tell you that this video, as a mother, is not anything that you want to see,” said Rochester Mayor Lovely Warren. “This is not something that any of us should want to justify, can justify … And it is something we have to change.”

According to the Democrat & Chronicle, the department suspended one officer with pay and put two others on administrative leave. The officers' names have not be released.

On January 29th, a woman called 9-1-1 due to a "vehicle dispute" at her Avenue B home in Rochester, according to the notice of claim. Once police arrived, the woman’s daughter reportedly ran outside, so the mother asked the officers for help. Apparently the child was "upset about her mother and step-father arguing."

Body cam footage released by the department (on Sunday) of what happened when police arrived has sparked outrage. The police cam footage showed the officers trying to deescalate the situation between the child and her mother, but things quickly escalated. The 9-year-old girl refused to get in the back of the police cruiser and that’s when misconduct from the police started. Officers were seen pushing the young girl in the snow in order to handcuff her as she screamed for her father.

During the struggle, an officer is heard telling the girl, “You’re acting like a child,” and she responded, “I am a child.”  Which, she is and should have been treated as such.

The child continued to refuse to get into the cruiser, so one officer pulled out pepper spray. After she defied commands to get her feet inside of the police cruiser, she was pepper sprayed in her face!

According to the police, the 9-year-old was threatening to harm herself and her mother.

Also, Rochester Deputy Chief Andre Anderson defended the officers' actions as well.

“They were trying to get her in the car,”  he said at a news conference Sunday. “[The officer] made a decision that he thought was the best to take. It resulted in no injury to her … Had they had to go and push further, and use more force, there’s a good chance she could have been hurt worse.”

New York State Attorney General Letitia James tweeted her office will be looking into the incident that transpired. She called the incident “deeply disturbing and wholly unacceptable”.

 

The 9-year-old child was detained under the state’s mental hygiene law. After her arrested, she was taken to Rochester General Hospital where she treated and released to the custody of her mother.

Now, the mother of the 9-year-old child is prepping a lawsuit based on the alleged violation of her daughter’s constitutional rights. She has filed a notice of claim, which is the first step.

“I definitely want to see a change in the system,” Elba Pobe told NBC News correspondent Ron Allen on Tuesday. “I trusted the Rochester Police Department to do what they needed to do to help my daughter, not to abuse her or hurt her at all.”

“It’s not her fault,” Pobe said. “I don’t ever want her to feel like being pepper-sprayed was the option or the right way to handle her. Regardless of what the situation may have been, that’s still my first born, my baby, my child. You don’t treat anyone like that,” she said.

According to the claim the mother filed, police never told her that her daughter was “pepper-sprayed or that they struggled with the child, handcuffed her, and arrested her.” It’s reported the child was “injured” and is now dealing with “substantial pain.”
